OFFICIAL RULES
NO PURCHASE NECESSARY, PURCHASES DO NOT INCREASE YOUR CHANCES OF WINNING. ODDS OF WINNING DEPEND ON NUMBER OF ENTRIES RECEIVED. 
1. Eligibility: The Specialty Retailers, Inc. On-Line Customer Service Survey Promotion and Giveaway (the “Giveaway”) is open only to legal residents of the United States excluding Delaware, Florida, Kansas, Michigan, Ohio, and Wisconsin, who are at least 18 years of age at the time of entry. 
Employees of Sponsor, Administrator and their parent and affiliate companies, suppliers as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. 
Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor's and Administrator’s decisions, which are final and binding in all matters related to the Giveaway.  Winning a prize is contingent upon fulfilling all requirements set forth herein.  Subject to all applicable federal, state and local laws and regulations.  Void where prohibited.
2. Sponsor and Administrator: Sponsor is Specialty Retailer's Inc.  10201 Main Street Houston, TX 77025.  Administrator is Mystery Shoppers, Inc., 8140 N. Mopac Expy. Bldg. 1, Ste. 230, Austin, TX 78759.
3. How to Enter: NO PURCHASE NECESSARY, PURCHASES DO NOT INCREASE YOUR CHANCES OF WINNING.  Simply log onto www.stagestores.com/survey and complete the survey process; you will automatically be entered into the Giveaway.  Sponsor is not responsible for incorrect personal or contact information provided by you during the survey process.  Failure to provide name and contact information that allow Sponsor to notify you in the event your name is selected in the random drawing will result in your entry being disqualified.  One entry per person and/or per email address.
4. Timing: The Giveaway entry period begins July 15th and ends August 1st, 2009 (the "Promotional Period").  To be eligible, entries must be received during that time.  Winner selection and prize distribution will take place after the entry period.
5. Winner Determination: Potential winners will be randomly selected from all eligible entries received during the Promotion Period; to be eligible, entries must be submitted within the Promotional Period linked to that drawing.  Any entry selected that does not contain valid or then current contact information for the entrant will be discarded, and another potential winner will be selected.  Once Sponsor identifies that the potential winner is eligible, a prize will be awarded.  For information on who wins, send a self addressed stamped envelope to Specialty Retailer's, Inc. 10201 Main Street Houston, TX 77025 Attn: Survey Sweeps Winner List no later than September 30, 2009.
6. Verification:  All potential winners are subject to verification by Sponsor.  An entrant is not a winner of any prize, even if notified of being a winner unless and until the entrant's eligibility has been verified.  Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements.  Any potential Giveaway winner will be notified by email or phone, after the random drawing selection.  If a potential winner of any prize cannot be contacted, fails to sign and return the Affidavit of Eligibility, Liability and Publicity Release within the required time period, or if the prize is returned as undeliverable, the potential winner forfeits prize and another winner will be selected from the remaining entries. 
7. Prize: One of Four (4) Customer Appreciation Gift Card with a $1000.00 value redeemable. One winner will be chose from each of our Sponsor retail location (Stage, Palais Royal, Peebles, and Bealls (excluding Bealls Florida)).  All applicable taxes, fees and surcharges on prizes are the sole responsibility of winner. PRIZE MAY NOT BE REDEEMED FOR CASH.  Prize is non-transferable and may not be assigned and must be accepted as awarded. If winner is deemed a minor in his/her state of residence, prize will be awarded in the name of a parent or legal guardian.
8. Release: By entering this Giveaway or winning a prize, winner agrees to release and hold harmless Sponsor, Administrator, and their respective subsidiaries, affiliates, vendors, advertising or promotional agencies, distributors, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Giveaway or receipt or use or misuse of any prize. Void where prohibited.
9. Publicity: Except where prohibited, participation in the Giveaway constitutes winners consent to Sponsor’s use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional or advertising purposes in any media, worldwide, without further payment or consideration.
10. General Conditions: Sponsor reserves the right to suspend and/or modify the Giveaway, or any part of it, if any fraud, technical failure or other factor beyond Sponsor’s reasonable control impairs Sponsor's ability to properly conduct the Giveaway, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes at random from among the eligible entries received up to the time of the factor. Sponsor reserves the right to disqualify any individual found to be in violation of these Official Rules. Any attempt to undermine the operation of the Giveaway may be a violation of criminal and civil law, and Sponsor reserves the right to seek damages to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
11. Limitations of Liability: The Released Parties are not responsible for: (1) technical failures of any kind, (2) any incorrect or inaccurate information, whether caused by entrants, printing or computing errors or by any of the equipment or programming associated with or utilized in the Giveaway; (3) unauthorized human intervention in any part of the entry process or the Giveaway; (4) technical or human error which may occur in the administration of the Giveaway or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Giveaway or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Giveaway, provided that if it is not possible to award another entry due to discontinuance of the Giveaway, or any part of it, for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that technical or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed.
12. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate federal or Texas State Court located in Harris County, Texas; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules (whether of the State of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas.  By participating in this Giveaway, you agree to waive any argument or right to contest personal jurisdiction in Harris County Texas.
